General Terms and Conditions and Return Policy

1. Scope of Applicability:

All of our sales and special offers towards consumers are subject solely to these gen-eral terms and conditions of Joyson Safety Systems Aschaffenburg GmbH in their latest version. The conditions that follow apply to shipments within Germany. Special international shipping conditions apply to deliveries within the European Union.

2. Prices, Shipping Costs, Delivery:

All prices stated are final prices in Euros and include all legally applicable sales tax/VAT and all price components (e.g. shipping and handling).

As a rule, we ship goods ordered from us immediately upon receiving the order and the amount due being credited to our account. Other delivery conditions may apply to par-ticular special offers. You will immediately be informed should goods not be available and any payment in advance will be reimbursed.

Delivery times may be extended in instances of force majeure, for example due to strikes, lock-outs, or other circumstances for which we cannot be held responsible that may hinder or delay delivery.

We use DPD or a comparable delivery company for postal shipments. You will receive notification from us once the goods have left our premises. Should delivery not be possible for any reason, you will also be informed by us.

3. Conclusion of the Contract:

The display of any item in our online shop does not constitute a legally binding offer. The customer has the option to make a binding offer to us on their part. With placing the order the customer is concluding a legally binding offer to conclude a contract with respect to goods that are submitted for purchase in the online shopping cart.

Once an order is received in the online shop, consumer automatically receive a confir-mation email showing what they have ordered. This confirmation email contains the contractual terms, the details of the order and these general terms and conditions. It confirms only that we have received the order and does not lead to the conclusion of a contract (except in cases of pre-payment/instant bank transfer).

A binding purchase contract between ourselves and the consumer only comes into ex-istence once we accept the customer’s offer in writing by sending you an offer acceptance email, or through delivery of the goods. If you choose to pay in advance or by instant transfer, the purchase contract is then established by the confirmation email ac-knowledging receipt of your order.

4. Contract Language:

The language of the contract is English.

5. Payment Terms:

Customers in the TAKATA CHILD SEATS SHOP can pay by credit card, instant bank transfer or PayPal (pre-payment).

Paying by credit card (Visa, Mastercard): your card will be charged on the day of your order.

You can also pay directly using your PayPal account: once you submit your order, you will be automatically redirected to the PayPal site where you can approve the amount of your payment. We will send you your goods as soon as our PayPal account receives authorization of your payment. Upon shipment of the goods, your PayPal account will be charged with the actual invoice amount.

In the case of instant bank transfers, we will ship any goods ordered as soon as the invoice amount has been credited to our account.

When paying on account, you agree to pay the invoice amount within 30 days of receipt of the goods. Under purpose, please enter your order number.

6. Right of revocation

Right of revocation

When acting as a consumer, you may declare the revocation of your contractual statement in text form (e.g. letter, email, Fax) within a period of 14 days or –when you receive the merchandise before expiry of this period –by returning the merchandise. The revocation does not have to contain any grounds.

The right of revocation does not apply for distance contracts

- for the supply of goods produced according to customer specifications or clearly tailored to personal needs or which, by reason of their quality, are not suitable for return or may spoil quickly or whose expiration date would be exceeded,

- or for the delivery of audio or video recordings or of software where the seal on the data carriers has been broken by the consumer,

- or for the delivery of newspapers, periodicals and magazines.

Consequences of revocation

In case of a valid revocation, all mutually received performances as well as emoluments taken (e.g. interest), if applicable, are to be restituted by either side. If you are unable or partially unable to restitute the merchandise as well as emoluments to us or can only restitute it in a deteriorated condition, then you have to compensate for its value where applicable. This does not apply if the deterioration is exclusively due to examining the merchandise, as for instance in a retail store.

Things that can be shipped by parcel are to be returned on our risk. You are obliged to bear the costs of the return shipment, if the merchandise delivered corresponds to the merchandise ordered, and if the price of the merchandise to be sent back does not exceed an amount of forty Euros or if, where the price is higher, you have at the date of the revocation not yet rendered consideration or given a part payment. Otherwise, the return shipment for you is free of charge. All reimbursement obligations must be fulfilled within 30 days of the declaration of revocation. This period begins for you with the dispatch of your revocation or the merchandise, for us with their receipt.

7. Voluntary Right of Return within 30 Days

For all purchases we provide, besides the legal right of revocation, a voluntary right of return within 30 days after receipt of the goods. With this right of return you are also able to rescind the contract after the end of the revocation period of 14 days (see the cancellation policy above) by sending back the goods within 30 days after receipt (revocation period begins the day after you received the goods) to the following address:

To observe the revocation period, it is sufficient to send back the goods in time.

For the repayment we will use the same payment method you have used for the initial transaction. In no case shall we charge you additional amounts because of this repayment. We may refuse the repayment until we receive the goods or until you supplied evidence of having sent back the goods, whichever is the earlier. You only have to pay for a possible loss in value of the goods, if this loss of value is due to a handling that is not necessary for the examination of the nature, characteristics and functioning of the goods.

Your legal right of revocation will not be affected by the exercise of our supplementary, voluntary right of revocation and will remain irrespective of this. Before the end of the legal revocation period, the contained statutory regulations shall apply exclusively. Furthermore, the contractually granted voluntary right of return does not restrict your legal right of warranty, which remains preserved for you without limitation.

8. Warranty:

Should any goods be faulty when delivered to you, the standard legal warranty provi-sions apply. The warranty period for statutory claims for defects is 24 months following receipt of the goods.

9. Data Protection and Storage of the Contract Text:

Our data protection policy is in line with that of Germany’s Data Protection Act (BDSG) and European General Data Protection Regulation (EU-GDPR).

10. Applicable Law:

This agreement is subject to the laws of the Federal Republic of Germany.

11. Severability Clause:

Should any of these provisions prove to be ineffective, the effectiveness of the remain-ing provisions shall remain unaffected.
